Terms of use
These terms govern your access to and use of SafeKit. By creating an account, you agree to them.
1. Acceptance of terms
By downloading, installing, or using SafeKit, you agree to these terms of use and to our privacy policy. If you're using SafeKit on behalf of an organization, you're confirming that you have the authority to bind that organization to these terms.
2. Description of service
SafeKit is a password manager that allows users to generate, store, organize, synchronize, and autofill passwords and other confidential information using client-side encryption so that decrypted vault contents and your master password are not accessible to us.
We may add, modify, suspend, discontinue, or remove features or functionality at any time. We do not guarantee that any particular feature or service will remain available indefinitely.
Some functionality may rely on third-party providers. We are not responsible for interruptions, failures, or security incidents affecting third-party services beyond our reasonable control.
3. Accounts and eligibility
You must be at least 16 years old to use SafeKit. You're responsible for the accuracy of the information you provide when using SafeKit, and for keeping your credentials confidential.
You are solely responsible for maintaining backups of any information stored in SafeKit where loss would cause damage. While we make reasonable efforts to preserve encrypted data, we do not guarantee that stored information will never be lost, corrupted, deleted, or become inaccessible.
4. Your responsibilities
You are responsible for maintaining the security of your devices, accounts, recovery methods, authentication credentials, and master password. You should use strong passwords, keep your software updated, enable multi-factor authentication where available, and protect recovery information from unauthorized access.
You agree to notify us promptly if you believe your account, device, or credentials have been compromised.
You remain responsible for all activity performed using SafeKit applicaiton unless prohibited by applicable law.
Although SafeKit employs industry-standard security measures, encryption, and security testing, no software or online service can guarantee absolute security. Cyberattacks, hardware failures, software defects, supply-chain compromises, internet outages, user error, malicious third parties, or other events may result in data loss or unauthorized access despite reasonable precautions.
5. Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, modify, or attempt to discover the source code except where expressly permitted by applicable law.
- Use SafeKit for unlawful, fraudulent, abusive, or malicious purposes.
- Attempt unauthorized access to our systems or other users' accounts.
- Upload malware, ransomware, viruses, or other harmful software.
- Perform automated scraping, excessive automated requests, or denial-of-service attacks.
- Circumvent security measures, authentication mechanisms, licensing restrictions, or usage limits.
- Use SafeKit in violation of export control, sanctions, or applicable laws.
- Copy, distribute, sublicense, rent, lease, sell, or commercially exploit SafeKit without our written permission.
- Conduct penetration testing, vulnerability scanning, or security research against SafeKit without prior written authorization.
6. Subscriptions and billing
Paid subscriptions automatically renew until canceled. You may cancel renewal at any time before the next billing period. Unless required by applicable law, fees already paid are non-refundable.
Prices, subscription plans, taxes, and available payment methods may change. Changes apply only to future billing periods after reasonable notice where required by law.
Payments are processed by independent third-party payment providers. We do not store complete payment card information.
7. Intellectual property
SafeKit and its underlying software, design, and branding are owned by us or our licensors and protected by intellectual property law. These terms grant you a personal, non-transferable license to use SafeKit, they don't transfer any ownership rights to you.
8. Disclaimers
SafeKit is provided on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, compatibility with every device, error-free operation, or that the Service will always be secure or free from vulnerabilities.
Any security audits, independent reviews, or testing do not constitute a warranty that SafeKit is immune from vulnerabilities or future security issues.
Beta, preview, or experimental features may contain defects, change without notice, or be discontinued at any time.
The application may automatically install updates, security patches, configuration changes, and improvements necessary for security, stability, or functionality.
Personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including the GDPR where applicable. Nothing in these Terms limits any rights you may have under mandatory data protection laws.
9. Limitation of liability
To the fullest extent permitted by applicable law, SafeKit and its developer shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages, including loss of profits, revenue, business opportunities, goodwill, reputation, data, passwords, encrypted information, or business interruption.
We are not responsible for losses resulting from forgotten master passwords, lost recovery keys, user error, device failures, malware, phishing, third-party attacks, internet outages, or events beyond our reasonable control.
Our total aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us during the twelve months immediately preceding the claim or (b) USD $100, except where a greater amount is required by applicable law.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless SafeKit and its developer from and against any claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from:
- Your use or misuse of SafeKit;
- Your violation of these Terms;
- Your violation of applicable law;
- Your infringement of any third-party rights.
11. Termination
You may stop using SafeKit and delete the application at any time. We may suspend or terminate an app that violate these terms, with notice where practical. On termination, your right to use SafeKit ends immediately, though certain provisions of these terms will continue to apply.
12. Governing law
These terms are governed by the laws of the jurisdiction in which SafeKit is incorporated, without regard to conflict-of-law principles, unless local consumer protection law requires otherwise.
13. Force majeure
We shall not be liable for delays, failures, or interruptions caused by circumstances beyond our reasonable control, including natural disasters, armed conflict, terrorism, governmental actions, labor disputes, internet failures, cloud provider outages, cyberattacks, or failures of third-party infrastructure.
14. Changes to these terms
We may update these terms from time to time. We'll notify you of material changes by email or in-app notice before they take effect. Continuing to use SafeKit after changes take effect means you accept the updated terms.
General provisions
If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any provision shall not constitute a waiver of that provision or any other rights.
These Terms constitute the entire agreement between you and SafeKit regarding your use of the Service and supersede prior agreements relating to the Service.
We may assign or transfer these Terms as part of a merger, acquisition, sale of assets, or transfer of the Service.
Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law, and any provisions that by their nature should survive termination shall survive termination of these Terms.
